YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT BEFORE INSTALLING ANY OF THE SOFTWARE PROGRAMS. BY INSTALLING OR USING THE SOFTWARE PROGRAM, YOU ACKNOWLDGE THAT YOU HAVE READ THIS AGREEMENT, ACCEPT AND AGREE TO BE BOUND BY THIS LICENSE AGREEMENT. DO NOT LOAD THE SOFTWARE ONTO YOUR DEVICE IF YOU DO NOT AGREE TO THE TERMS IN THIS AGREEMENT.
Battery Watch remains the owner of all right, title and interest in the Software. This Agreement and any supplemental terms form the entire agreement between you and us regarding the subject matter of this Agreement, which may only be modified by Battery Watch at anytime without any prior notification. You warrant that you will use the Software only for lawful purposes and that you will remain in compliance with all of the stated terms in this Agreement.

License Restrictions

You must not copy or modify the Software; transfer, sub-license, lease, lend, rent or otherwise distribute the Software to any third party; or use the Software in any unlawful manner, for any unlawful purpose, or in any way inconsistent with this EULA.

Proprietary rights
<br/><br/>
You agree that Battery Watch owns all right, title and interest in and to the Software including without limitation all intellectual property rights therein. You will not delete or in any form alter the copyright, trademark and other proprietary rights, notices, or markings appear on the Software as delivered to you.

Term and Termination
<br/><br/>
This EULA and the license granted to you under this EULA terminate automatically if you breach any term of this EULA. Your license to use the Software under this EULA shall continue until it is terminated by either party. You may terminate this EULA at any time, by discontinuing use of all or any of the Software and by destroying all copies of the Software in your possession and control. You must destroy all copies of the Software in your possession or control upon termination.

Limitation of Liability

YOU UNDERSTAND AND AGREE THAT WE OR OUR AFFILIATES, DIRECTORS, EMPLOYEES, DISTRIBUTORS, LICENSORS, SUPPLIERS ARE NOT LIABLE TO YOU UNDER ANY THEORY OF LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU THROUGH YOUR USE OF THE APPLICATION, INCLUDING ANY LOSS OF DATA OR DAMAGE TO YOUR MOBILE DEVICE, WHETHER OR NOT THE COMPANY OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILTY OF ANY SUCH LOSSES ARISING.
